Terms and Conditions – 1stBike


  1. General

These terms and conditions apply to all sales of used motorcycles by 1stBike (“the Dealer”) to the customer (“the Customer”).

These terms and conditions do not affect the Customer’s statutory rights.

The Dealer reserves the right to amend these terms and conditions at any time. Any such amendments will be effective immediately upon being posted on the Dealer’s premises and website.

The Customer acknowledges that they have had the opportunity to read, understand, and agree to these terms and conditions.

  1. Motorcycle Information and Inspection

The Dealer shall make reasonable efforts to provide accurate descriptions of used motorcycles, including their make, model, year, mileage, and known faults.

Used motorcycles are sold “as is,” with all faults, except where statutory rights apply.

The Customer is strongly encouraged to inspect the motorcycle thoroughly before purchase, including test riding (subject to the Dealer’s discretion and insurance requirements).

The Customer acknowledges that used motorcycles may have imperfections consistent with their age and mileage.

Any statements or representations made by the Dealer’s employees are not binding unless confirmed in writing by an authorized representative of the Dealer.

  1. Purchase Price and Payment

The purchase price of the motorcycle is as agreed between the Dealer and the Customer and is stated on the sales invoice.

A deposit may be required to secure the motorcycle, the amount of which will be agreed upon at the time of sale.

The balance of the purchase price is due in full before the Customer takes possession of the motorcycle.

Accepted methods of payment are [Specify accepted payment methods, e.g., cash, credit/debit card, bank transfer].

The Dealer reserves the right to withhold the motorcycle until full payment has been received and cleared.

  1. V5 and Risk

Title to the motorcycle shall pass to the Customer only upon receipt of full payment of the purchase price.

Risk of loss or damage to the motorcycle shall pass to the Customer upon delivery of the motorcycle to the Customer. Delivery is deemed to occur when the Customer takes physical possession of the motorcycle.

  1. Delivery and Collection

The Customer is responsible for collecting the motorcycle unless a separate delivery agreement is made with the Dealer.

If a delivery agreement is made, the terms, conditions, and costs of delivery shall be agreed upon in writing.

If the Customer fails to collect the motorcycle within [Number] days of being notified that it is ready, the Dealer reserves the right to charge reasonable storage fees. If the Customer fails to collect the motorcycle within [Number] days, the dealer may treat the contract as repudiated.

  1. Warranty

Used motorcycles are sold with the following warranty: 60 days unless changes specified. Where able items like, tyres, brake pads, clutches not covered. Mileage limit of 1000 miles per month and use of the bike outside the manufacturers designed purpose will be void.

The Customer is responsible for ensuring the motorcycle is properly maintained and serviced in accordance with the manufacturer’s recommendations, which may affect warranty validity.

  1. Returns and Cancellation

The Customer may have a right to cancel under the Consumer Contracts Regulations (for distance sales), the specifics of which will be detailed in a separate document.

For sales where the customer is on the dealer’s premises, there is generally no statutory right to return a used vehicle unless it is not of satisfactory quality.

Any returns or cancellations are subject to the Dealer’s discretion and must be agreed upon in writing. The dealer may impose reasonable restocking fees. 14 day cool off period. After this the customer can decide to return the bike if the bike is not fit for purpose within the warranty period.

  1. Limitation of Liability

To the fullest extent permitted by law, the Dealer’s liability for any defect in the motorcycle is limited to the purchase price of the motorcycle.

The Dealer shall not be liable for any indirect, incidental, or consequential damages arising from the sale of the motorcycle, including but not limited to loss of use, loss of profits, or inconvenience.

Nothing in these terms and conditions shall limit or exclude the Dealer’s liability for death or personal injury caused by its negligence, or for fraud.

  1. Customer Responsibilities

The Customer is responsible for ensuring they have a valid motorcycle license and insurance.

The Customer is responsible for registering the motorcycle and complying with all applicable laws and regulations. Dealer will arrange the transfer of the vehicle via DVLA in a reasonable time period. Any mistakes made by the purchaser on address details leading to a replacement V5 having to be issued is the responsibility of the purchaser. The customer can request the vehicle tax to be added at an additional cost.

  1. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of [State/Jurisdiction].

Any dispute arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of [State/Jurisdiction].

  1. Data Protection

The dealer will comply with all applicable data protection laws. Customer data will be used to process the sale and may be used to contact the customer about related products and services. The dealer’s full data protection policy is available upon request. GDPR data will be collected on purchasers and leads where 1stBike has been contacted and we may respond at a later date if the situation relating to their enquiry changes. No data will be shared with 3rd parties and will solely be used to facilitate the purchase.

  1. Entire Agreement

These terms and conditions, together with the sales invoice, constitute the entire agreement between the parties.
